This bill would eliminate mandatory
motorcycle helmet use by adult riders. It includes exceptions for
riders and passengers over 21, for those who have taken a motorcycle
safety course, or for those who have two or more years riding experience.
The bill was heard in the Judicial Proceedings (JPR) Committee on February
19, 2004 at 1 pm. It received a favorable committee vote and
moved on to a full floor vote in the Senate. The bill passed the
full Senate with a vote of 26 Yeas and 21 Nays.
Next the bill moved over to the House of Delegates. Unfortunately, it did not get to the House Environmental Matters committee in time for consideration there. The Session ended before the bill could be voted on by the House of Delegates.
During the hearing, we were told by the committee chairman that we already had the committee vote.
